1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site. We reserve the right to update these Terms at any time; your continued use of the Site constitutes acceptance of the revised Terms.

2. Services

EM Group provides software development and IT services including, but not limited to, web applications, professional webpages, IT project management, and in-house application development. Service delivery is governed by separate client agreements or statements of work, which take precedence over these Terms where applicable.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not:

  • Violate any applicable local, national, or international law or regulation
  • Transmit unsolicited promotional material or spam
  • Attempt to gain unauthorised access to any part of the Site or its related systems
  • Introduce malicious code, viruses, or other harmful material
  • Reproduce, duplicate, or exploit any portion of the Site without our express written permission

4. Intellectual Property

All content on the Site — including text, graphics, logos, icons, images, and software — is the property of EM Group or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, modify, distribute, or exploit any content without our prior written consent.

Client deliverables (code, designs, documentation) produced under a client agreement are subject to the intellectual property terms outlined in that agreement.

5. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, EM Group, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms shall not exceed AUD $100.

The Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
